Florida Riders and Freedom Fighters:

Appended below is an email from the state leadership of ABATE of Florida giving you guidance as to what you should be saying to your state legislators. With respect to proposed bills HB-137 and SB-802, I believe you will find superior guidance here:

Subject: Prepare for the Freedom Ride...

From Jeff Baxla...

Yes, Spring has sprung and all of the sudden it is upon us. Within a few short weeks it will be time for our Tallahassee Run.

Don't forget to invite non-members to come, you can direct them to http://www.abateflorida.com/ for more info.

I am hopeful that all of the grief we have suffered from HB137 will result in a wad of sport bikes riding along with us to the Capitol on Monday.

If you do not already have an appointment, letters and email are great, but picking up the phone and making an appointment is a very viable option. Another favorite is to stop in your local office and make an appointment from there.

If you still need to make an appointment, whether you write, call, email or go by the office to ask for appointments, the example letter below from John may be helpful

At a minimum please try to make sure you or your Chapter have appointments with your State Senator and State House member.

Please make sure your Chapter Legislative Rep and whoever is going to represent your Chapter at the State Meeting knows your appointment schedule and who you have appointments with - JUST IN CASE we have some key vote issues that would mean our lobbyist might want to attend with you.

The Honorable Evelyn Lynn
212 Senate Office Bldg.
Tallahassee, Florida 32399-1100

Dear Senator Lynn,

I will be in Tallahassee, participating in the ABATE of Florida Motorcycle Rights Rally on Monday, April 14, 2008. I respectfully request an opportunity to speak to you or a member of your staff about pending legislation concerning motorcyclists and traffic safety. I am anticipating being in the Senate Office building by 10:30 AM. There is legislation that seeks to promote traffic safety. However, not all interesting ideas are written to become good laws. Some of my concerns might be addressed during the committee process. At this time, the issues concerning motorcyclists, that will be discussed, are:

Stunt Driving on Public Roads HB 137 was unacceptable until it was changed in the House Transportation committee. Staff reports state that there are existing laws dealing with reckless driving (riding). SB802 is not identical. SB802 does deal with reckless driving but fails to define exactly what type of motorcycle driving warrants first time seizure of a motorcycle. Automobile drivers do not appear to face vehicle impoundment for a first time arrest for poor driving. SB802 does cover other issues concerning license plates which are needed by law enforcement to prevent high speed chases.

HERE IS AN ALTERNATIVE PERSPECTIVE ON THESE ISSUES:

"HB 137 was unacceptable until it was changed in the House Transportation committee".

Does this mean it is now acceptable?

This bill is nothing but smoke and mirrors. Draconian punishments for motorcycles thinly disguised as applying to all vehicles. But have they yet to consider more than a slap on the wrist for motorists that violate right of way resulting in injury or death to a motorcycle?

Seizure of personal property is a slippery slope and that is still an option in this bill.

First it was this bill is dead.
Then it was stop calling your legislators.
Then it was ABATE is opposed to this bill.
Now it is "acceptable"?????????

Between this issue and the Cell phone issue ABATE of Florida has done more flip flops than an Olympic Gold Medal Gymnast.

You don't need a weatherman to tell which way the wind blows but you sure need a map to figure where it is ABATE goes.

Cell Phone Usage while Driving. Motorcyclists want restrictions on cell phone usage. I have looked at NHSTA reports, but my own experience using a cell phone indicates that it is a dangerous distraction while driving. HB357/SB1266 and S1314 are the most restrictive and also cover other dangerous distractions. I have personally seen automobile drivers, exceeding the speed limit in I95, reading newspapers or books. I realize that cell phones are used in a tremendous amount of daily business. HB175/SB266 would allow hands free usage, HB193/SB504 creates restrictions for those under 18 years of age, and S608 creates restrictions in school zones. I will be interested to find out how the legislature and general public feel about this issue.

Drivers Education Informed motorcyclists support the accessibility and affordability for educating new drivers. At this time I do not know if HB1299/SB2678 are good bills.

Mandatory Riders Training for New Motorcycle License Endorsement The DHSMV is presently refining the language of the statue set to become effective this summer. My November 11, 2007 letter outlined my concerns. Hopefully the corrective language will be in one of the massive correction bills.

I personally like CS/SB282, which you sponsored. I will call the week prior to confirm the availability of someone to talk to.

Best regards, John Banta
